These Terms of Service (“Terms”) govern your use of the NuSee mobile application (the “App”), operated by American Global Nexus LLC (“we”, “us”, “our”). By creating an account or using the App, you agree to these Terms.
1. What NuSee Does
NuSee lets you scan grocery products to see health scores, ingredient information, prices, deals, and healthier alternatives, and to track purchases and budgets from receipts you scan. The App is free to download and contains no advertising; scanning features require a paid subscription (see Section 2A).
2. Your Account
- You must be at least 13 years old to use the App.
- You are responsible for the accuracy of information you provide and for keeping your sign-in method secure.
- You may delete your account at any time in the App (Profile → Account → Delete Account).
2A. Subscriptions and Billing
- NuSee Premium is an auto-renewing subscription purchased through your Apple ID (monthly or annual). Pricing is shown in the App before you subscribe.
- Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel it in your device Settings → Apple ID → Subscriptions.
- Refunds are handled by Apple under Apple’s media services terms.
- Promotional offers (for example, founding-member benefits for early subscribers) apply only while your subscription remains active and may be modified prospectively; accrued benefits are not revoked retroactively.
- We may change subscription prices with notice; changes apply at your next renewal, and Apple will ask you to confirm where required.
3. Health and Nutrition Information
Health scores, ingredient assessments, and dietary flags are automated general guidance based on published nutrition science and product data. They are provided for informational purposes only and are not medical advice, diagnosis, or treatment. Product formulations change; always read the physical label — especially for allergens — and consult a qualified healthcare professional for medical decisions. Do not rely on the App as your sole safeguard against allergens.
4. Prices and Deals
Prices, deals, and availability shown in the App are estimates assembled from retailer data, public sources, and anonymized shopper observations. They can be outdated or wrong, and the price at the register controls. We are not affiliated with, endorsed by, or sponsored by any retailer or brand shown in the App; store and brand names are used only to identify products and locations.
5. Acceptable Use
You agree not to:
- Reverse engineer, scrape, or bulk-extract data from the App or its services;
- Submit false or manipulated data (for example, fabricated receipts or prices);
- Use the App in violation of any law or third-party right;
- Interfere with or disrupt the operation of the App.
We may suspend or terminate accounts that violate these Terms.
6. Content You Submit
You retain ownership of the content you submit (such as receipts you scan and preferences you enter). You grant us a license to process that content to operate the App, including contributing anonymous, aggregated price observations to improve price accuracy for all users, as described in our Privacy Policy.
7. Intellectual Property
The App, its design, software, and the NuSee name and logo are our property or licensed to us. These Terms do not grant you any right to use our trademarks. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your devices for its intended purpose.
8. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SCORES, PRICES, OR PRODUCT INFORMATION ARE ACCURATE, COMPLETE, OR CURRENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICAN GLOBAL NEXUS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Changes to the App and These Terms
We may modify or discontinue features at any time. We may update these Terms; material changes will be posted on this page with a new effective date. Continued use of the App after changes take effect constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the United States and the state in which American Global Nexus LLC is organized, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in that state.
